합리적 의심

나는 진실이 무고한 사람을 지켜 준다고 믿는 국선변호인이다. 그런데 한 의뢰인을 맡고 나서 알게 된다. 의심은 찾아내는 것이 아니라 만들어 내는 것이라는 걸. 나는 그 일을 너무 잘하게 되고, 어느 순간 내가 꾸민 말과 진실을 구분하지 못한 채 그것을 팔기를 멈추지 못한다.

A는 국선변호인이다.

감당하기 힘든 학자금 빚에 눌려 살지만, 누구에게나 변호받을 권리가 있다는 믿음만은 고집스럽게 붙들고 있다.

그는 재판에서 자주 지고, 잠도 제대로 자지 못한다.

그러던 어느 날 살인 혐의를 받은 B가 찾아온다.

B는 말솜씨가 좋고 태도도 당당하지만, 거의 틀림없이 죄가 있어 보인다.

A는 이기기 위해 불안해하는 증인이 입을 다물도록 살짝 밀어붙이고, 자기 주장에 불리한 시각 기록은 조용히 덮어 둔다.

그리고 이긴다.

무죄 판결을 받은 그 순간, A는 처음으로 승리가 곧 정의처럼 느껴진다.

방청석에서 그 재판을 지켜본 큰 로펌의 고참 변호사 C는 A에게 자리를 제안한다.

빚을 단번에 갚을 수 있는 연봉도 함께다.

A는 그 제안을 받아들인다.

달라진 것은 값뿐이다.

일의 본질은 그대로다.

A는 의심도 상품이 될 수 있다는 사실을 배운다.

돈을 낼 수 있는 사람들을 위해 의심을 만들어 내고, 사건을 맡을 때마다 진실을 조금씩 더 깎아 낸다.

처음에는 망설이던 일도 점점 쉽게 받아들인다.

그러다 작고 정직한 사건 하나가 그의 책상 위에 놓인다.

돈은 없지만 정말로 무고한 의뢰인의 사건이다.

A는 늘 쓰던 방법을 꺼내려다 자신이 더는 무엇이 진짜인지 믿지 못한다는 사실을 깨닫는다.

그래도 그는 이긴다.

잘못된 방식으로.

이제 그가 아는 방법이 그것뿐이기 때문이다.

얼마 뒤 B가 다시 체포되고, 이번에도 A를 꼭 집어 부른다.

A는 맡겠다고 한다.

한때 진실이 무고한 사람을 지켜 준다고 믿었던 남자는 이제 죄 있는 사람들에게 의심을 팔며, 자신이 어느 편에 서 있는지도 더는 기억하지 못한다.

Reasonable Doubt

I am a public defender who believes the truth protects the innocent. One client teaches me that doubt is a thing you build, not find. I get good at building it. Soon I cannot tell my tactics from the truth, and I cannot stop selling them.

A is a public defender.

He carries crushing student debt and a stubborn belief that everyone deserves a defense.

He loses often and sleeps less.

B arrives charged with a killing.

B is charming, certain, and almost surely guilty.

To win, A nudges a nervous witness toward silence and buries a timestamp that does not help his story.

He wins.

The acquittal is the first time winning feels like justice.

C, a senior partner, watches the verdict and offers A a chair at a real firm and a salary that clears the debt.

A takes it.

The work is the same trick at a higher price.

A learns that doubt is a product.

He manufactures it for people who can pay, and each case asks for a deeper shave of the truth.

Each time, A agrees more easily.

The reversal comes when a small honest case lands on his desk: an innocent client with no money.

A reaches for his tools and realizes he no longer trusts what is real.

He wins anyway, the wrong way, because it is the only way he knows now.

Then B is arrested again and asks for A by name.

A says yes.

The man who once believed the truth would shield the innocent now sells doubt to the guilty, and can no longer remember which side he is on.
